Welcome to CaliFino. This website is operated by CaliFino Tequila ("CaliFino," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of this website and the services available through it (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Who may use the Services

• You must be at least 21 years of age.
• You must have the legal capacity to enter into binding agreements.
• All information you provide must be accurate and current.
• You are responsible for the security of any account you create.

Marketing, technology, and order facilitation

CaliFino Tequila produces CaliFino and uses this website to market it. CaliFino Tequila does not sell, offer to sell, or solicit sales of alcohol through this website. Checkout is provided by BarBank, a marketing, technology, and order-facilitation platform. Neither CaliFino Tequila nor BarBank sells or ships alcoholic beverages to customers. Alcoholic beverages offered through the Services are sold, fulfilled, and delivered by independently owned, properly licensed alcohol retailers in accordance with applicable law.

Seller of record disclosure

Orders placed through the Services are fulfilled by a licensed retailer in the BarBank retailer network. The licensed retailer is the seller of record for alcoholic beverage transactions. Title to alcoholic beverages transfers at the retailer's licensed premises, as required by law. BarBank may facilitate payment processing, order transmission, marketing, and delivery coordination on the retailer's behalf but does not take ownership of, or title to, alcoholic beverages.

This arrangement is not intended to facilitate any improper inducement by any manufacturer, importer, supplier, wholesaler, or distributor of alcohol to any retailer, or any improper exclusionary practice by any alcohol beverage licensee. The Services may be limited or unavailable in some places due to local law or other restrictions.

Age verification and delivery

• You and the intended recipient must be 21 years of age or older.
• A valid government-issued photo ID is required at delivery.
• An adult signature is required. Packages cannot be left unattended.
• Failed age verification may result in cancellation, return, or additional fees.

Purchases

• All orders are subject to acceptance by the licensed retailer.
• Prices, availability, and product details may change without notice.
• Applicable taxes, shipping, and compliance fees may apply.
• You authorize the charges submitted through the Services.

Billing statements and chargebacks

Charges may appear on your bank or credit card statement under the descriptor LiquorStoreNM-VWS or a substantially similar variation. If you believe a charge is incorrect, contact info@barbank.com before initiating a chargeback. Unauthorized chargebacks may result in account suspension.

Delivery terms

• Alcohol shipping laws vary by state, city, and ZIP code.
• Delivery timelines are estimates and are not guaranteed.
• Risk of loss and title transfer are governed by the licensed retailer's terms and our Shipping Policy.
• Incorrect addresses or failed delivery attempts may incur additional fees.

Responsible enjoyment

CaliFino Tequila is 40% alcohol by volume (80 proof). Please enjoy responsibly and never drink and drive.

Content and trademarks

The CaliFino name, label, artwork, photography, and all other content on this website are the property of CaliFino Tequila and may not be reproduced without permission, except for materials we make available for press and trade use.

No warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.

Liability limits

To the fullest extent permitted by law, neither CaliFino Tequila nor BarBank shall be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Jurisdiction

These Terms are governed by the laws of the State of California, with exclusive venue in San Diego County, California.
